6.2 The Operator’s total liability, if ever applicable, is strictly limited to the Vendor’s subscription fee paid, not exceeding one year of service.

7. USER RESPONSIBILITY

Users agree:

7.1 To use the Platform at their own risk.
7.2 To verify all Vendor information before purchasing.
7.3 To ensure their account credentials remain secure.
7.4 To report suspicious activity immediately.
7.5 To comply with applicable Malaysian laws.

8. VENDOR & RIDER RESPONSIBILITY

Vendors are responsible for:

• Food safety

• Business licensing

• Menu accuracy

• Pricing and promotions

• Customer service

• Compliance with food laws and PDPA

Riders are responsible for:

• Safe delivery

• Hygiene standards

• Road safety compliance

• Customer interactions

• Maintaining operational vehicles

The Platform is not liable for Vendor or Rider actions or omissions.

9. INTELLECTUAL PROPERTY DISCLAIMER

9.1 All content, software, logos, trademarks, and branding on the Platform belong to Netdesk Solution.

9.2 Unauthorized use, copying, modification, or distribution is strictly prohibited.

9.3 Photos uploaded by Vendors must not infringe any third-party rights. Vendors bear full responsibility for copyright violations.

10. SECURITY DISCLAIMER

10.1 The Operator employs reasonable security measures; however, no system is fully secure.

10.2 The Operator does not guarantee that:

• The Platform is free of viruses

• Communications are free from interception

• Cyberattacks will not occur

10.3 Users access the Platform at their own risk and must maintain device security.

11. FINANCIAL & PAYMENT DISCLAIMER

11.1 The Platform does not collect customer payments on behalf of Vendors.
All payments go directly to Vendors under the Vendor’s own POS or payment system.

11.2 The Platform is not responsible for:

• Customer payment disputes

• Refund approvals or denials

• Transaction errors by Vendors

• Failed or reversed payments
