DELIVERY RIDER AGREEMENT
Effective Date: Upon Rider Registration
Platform: Ordersini.asia
Operator: Netdesk Solution, Malaysia
1. DEFINITIONS
1.1 “Platform” refers to Ordersini.asia, including its mobile applications, website, rider management tools, and all related services.
1.2 “Operator” refers to Netdesk Solution (Enterprise), the Malaysia-registered business operating the Platform.
1.3 “Rider” means any individual registered on the Platform to deliver orders to Customers.
1.4 “Vendor” means a restaurant, food stall, or merchant selling food on the Platform.
1.5 “Customer” means an end-user receiving delivery services through the Platform.
1.6 “Hybrid Delivery Model” means that orders may be delivered by:
(a) Riders assigned by Ordersini.asia;
(b) Riders arranged by the Vendor; or
(c) Customer self-pickup.
1.7 “Delivery Service” refers to collecting orders from Vendors and delivering them to Customers using any lawful means of transport.
2. SCOPE OF AGREEMENT
This Agreement governs the relationship between the Platform and the Rider.
By registering as a Rider, the Rider agrees to comply with all terms contained herein.
The Rider operates as an independent contractor, not an employee, representative, or agent of Netdesk Solution.
3. ELIGIBILITY REQUIREMENTS
Riders must:
3.1 Be at least 18 years old.
3.2 Possess a valid Malaysian IC or Work Permit.
3.3 Hold a valid motorcycle license (Class B/B2) or other approved license.
3.4 Own or lawfully use a roadworthy vehicle.
3.5 Maintain valid insurance (third-party minimum).
3.6 Not have a criminal record involving violence, theft, or fraud.
3.7 Not have active drug or alcohol-related offenses.
The Platform may request verification documents at any time.
4. RELATIONSHIP OF PARTIES
4.1 The Rider is not an employee, and the Platform is not an employer.
4.2 No employment benefits apply, including:

EIS
-
Paid leave
-
Medical benefits
-
Overtime pay
4.3 The Rider is responsible for their own tax declarations and income reporting.
5. RIDER RESPONSIBILITIES
The Rider agrees to:
5.1 Deliver orders promptly, safely, and accurately.
5.2 Confirm order details before collecting from the Vendor.
5.3 Maintain good hygiene, including:

Clean attire
-
Clean delivery bag
-
Secure food handling
5.4 Treat Customers, Vendors, and support staff with respect.
5.5 Respond to delivery requests within a reasonable time.
5.6 Use the Platform’s rider app responsibly, without tampering or unauthorized modifications.
5.7 Ensure the correctness and safety of orders during transit.
5.8 Not open, taste, damage, or alter food items.
5.9 Not represent themselves as staff or employees of the Platform.
5.10 Follow road safety rules under the Road Transport Act 1987.
6. PAYMENT TERMS
Depending on the delivery assignment:
6.1 Orders delivered under Ordersini’s own rider system
Riders will be paid according to the internal rider payment structure:

Distance-based fee (if applicable)

Incentives (if any)
Payment methods may include:

Wallet payout
-
Bank transfer
-
Cash on delivery (COD), where applicable
6.2 Vendor-arranged deliveries
If the Vendor provides its own riders, the Platform is not involved in payment arrangements between Vendor and Rider.
6.3 Taxes
Riders are solely responsible for declaring income to LHDN.
7. USE OF VEHICLE AND EQUIPMENT
Riders must:
7.1 Maintain their own motorcycle, bicycle, or vehicle in good condition.
7.2 Ensure all equipment is lawful and safe for delivery.
7.3 Wear a helmet and comply with JPJ road rules.
7.4 Ensure a proper insulated delivery bag is used.
7.5 Not allow others to use their rider account or vehicle to perform deliveries.
8. PROHIBITED CONDUCT
Riders must NOT:
8.1 Steal, damage, or lose Customer or Vendor goods.
8.2 Engage in dangerous or reckless riding.
8.3 Consume alcohol or drugs while on duty.
8.4 Make fraudulent claims or manipulate delivery fees.
8.5 Verbally or physically abuse Customers or Vendors.
8.6 Mark orders as delivered when not delivered.
8.7 Attempt to open sealed containers or packaging.
8.8 Perform deliveries with expired licenses or unpaid summonses.
8.9 Share or sell Customer data (illegal under PDPA Malaysia).
8.10 Engage in any illegal activity while performing deliveries.
9. PENALTIES FOR RIDERS
The Platform may impose penalties for violations, including:

Warning letter

Temporary suspension

Permanent termination
-
Loss of incentives
-
Deduction of unpaid delivery fees (for proven losses)

Police report for criminal behavior
-
Legal action for damages
Immediate termination applies for:
-
Theft
-
Violence
-
Drug or alcohol consumption during delivery
-
Fraud
-
Dangerous riding causing injury
-
Sexual harassment
-
Repeated customer complaints
10. CUSTOMER INTERACTION RULES
Riders must:
10.1 Hand over orders politely.
10.2 Not request tips (allowed only if offered voluntarily).
10.3 Not argue, insult, or intimidate Customers.
10.4 Not enter Customer premises unless permitted.
10.5 Not request personal information other than what is shown in the app.
11. VENDOR INTERACTION RULES
Riders must:
11.1 Collect orders professionally.
11.2 Verify order number before leaving the Vendor.
11.3 Report delays to both Vendor and Customer (where applicable).
11.4 Not pressure Vendors for personal benefits.
12. LIABILITY
12.1 The Rider is responsible for:

Traffic summonses

Accidents
-
Vehicle maintenance
-
Food damage during transport
-
Loss of items
12.2 The Operator is not liable for:

Rider injuries
-
Accident costs
-
Insurance claims
-
Delivery vehicle damage
-
Third-party claims caused by Rider negligence
13. DATA PROTECTION (PDPA MALAYSIA)
Riders must comply with the Personal Data Protection Act 2010:
13.1 Customer phone numbers and addresses may only be used for fulfilling delivery.
13.2 Riders must not store, copy, share, or misuse Customer data.
13.3 Any data breach must be reported to the Operator immediately.
14. TERMINATION
The Platform may terminate Rider accounts:

For violating this Agreement

For receiving excessive complaints
-
For unsafe behavior
-
For illegal conduct
-
For fraud or misuse of the app
Riders may stop using the Platform at any time. There is no employment obligation.
15. GOVERNING LAW
This Agreement is governed by the laws of Malaysia, and disputes shall be resolved in the courts of Selangor or Kuala Lumpur.
16. ACCEPTANCE
By registering as a Rider on Ordersini.asia, the Rider confirms:

They understand and accept this Agreement

They operate as an independent contractor

They agree to all safety, conduct, and data protection rules

They agree to the penalty and termination clauses
Digital acceptance is legally binding.
